Legal Or Illegal (Page 2)

Updated

My doctor has had me on 1 mg xanax 4 times per day for 15 yrs now and oxycodone 30 mg 4 times a day. I was supposed to see him last Thursday to get my refills but when I called to make the appointment I was told that he quit indefinitely so now I'm going cold turkey without anything...my pharmacist faxed my refill orders several times last week & they told me they couldn't find my medical chart....1st time in 15 yrs my chart got lost & my refills for xanax were never called in to my pharmacy... Can he legally quit on me without informing me here in Arkansas?

What journalists call a "chilling effect" is affecting the medical profession today. I"ll put out feelers.

Oh, now you've picked up a law degree? From Yale, the same as my sister, who also holds a MLS along with her JD. It's not for you to determine if a malpractice case is viable. I know more about this than most, but not a lot, since we don't get sued very often — honest!

Hi Joey I emailed you and MedChat confidential information since I will likely be tied up literally with federal agency today I wanted to give you some background. You talk about NYS and wish it were legally as tight elsewhere it is not. Thank you for releasing email and look forward to feed back rarely do I reach out but you are so much like me (in detail and I love your knowledge) so thank you.

Stace it sounds like he's shut down. Recently the DEA did a 3 state shut down (Tennesee, Alabama, and WV) and when they do this depending on what they are seeking charts are grabbed I've seen patients also arrested.

I'd seek your records and immediate appointment with a new physician.

Ask your pharmacist who else in town writes if you have a good relationship.

When I called to make my regular appointment I was told over the phone that he "quit indefinitely". To clear up a few things, I never obtained an attorney bc of my doctor quitting, I had to obtain a lawyer from a vehicle accident in which my nose & the right side of my face has been fractured...I'm not the type to do legal cases, actually would rather not but I was contacted by a local law firm that persuaded me to let them help me out. My doctor put me on xanax when I was actually 18 or 19 yrs old....biggest regret of my life was getting that script filled bc at that time I had no idea how addictive it was till I ran out and went back to pick up my refill then the pain killers started when I was 21 yrs old & now I am 36 yrs old. I never wanted either of the medications but I thought it would fix my problems with anxiety and fix my pain unfortunately I had to learn the hard way...not once was surgery ever brought up to me as an option, doctor also never done blood work on me the whole time I was being treated by him. I just got a new doctor and just found that I have osteoporosis, degenerative disc disease, L5 is fractured in my back & have herniated disc. Thank all of u for your opinions I really appreciate all! God bless & have a good day.

Dr Joey, I had a rheumatologist for 3.5 years . For the last 3 years he took over my narcotic pain care so I wouldn't have to drive to the next state over. AnywY he had me on 300mg MS Contin, perc 10/325, and soma 350 mg , oh yea 4 Percs and 4 soma I've had three surgeries in the last two years and all the sergeons gave me extra Percs . He new about all of them, them last surgery on my c5 & c6 in aug of 2014, I had to stop taking my imuran as it could lower a positive bone graph from healing so he raised my remicaid infusions . I told him in sept and dec at my appt's after that surgery what they had given me for the pain from surgery, it was 60 extra 10/325 Percs he ask , I told him twice then he raised my monthly BT perscription FRON PERC 7.5/325 to 10:325 that was in dec if 2014. Then for some reason he sends me a letter in march of 2015 he sends me a letter saying he's dropping me as a pt. Period cold turkey on the narcotics, plus he knows it takes at least 3 mid to get I to a me rheumatologist . I live in Idaho, I called the AMA and they said a dr can drop you for any reason, and he can cold turkey you for any reason but there was no reason . He said it was because I got extra meds from the surgeon HE sent me to but he knew for six months and even raised my Percs from 7.5's to 10's ????WTF? I didn't think that was legal unless I broke my contract and I didn't so luckily I had a decent oct that started tapering me down on the morphine, but my new rheumy lowered my remicaid to 500 mcg a month from 900 mcg. It hardly even does anything at all . I tried fentanyl patches 75 mcg in June and they wore off in the middle if the second night. My ins will pay for 15 for 30 days so I was thinking now I can go to a lower patch , but the pcp said that if I changed um every 60 hours I'd get too much med . How is that possible if I take one off before bed and wait few hours to put on new one ? I really want to get off all these pills if I set my alarm for day 11pm and take a couple Percs will that stop the fish flipping at midnight till time to change patch? Or is that something that goes away after my body adjusts to the fentanyl ? I've read and been told so many diff things I wondered what you Thot I can try that second nite I go dr in three days so I'd like to kinda kniw what my options are ? ALSO CAN HE DO THAT TO ME JUST DROP ME COLD TURJEY AND EVERYTHING ELSE FOR NO reason?

Kipper are you really. First of all since you have excellent specialists get tested for your P450 DNA factor. If you (like me) are an ultra rapid opioid metabolizer. Normals do not get 72 hours from Duragesic. Other key pay close attention.

Duragesic brand 100mcg/hour is 16.7 mg. Fentanyl
Watson 100 mcg/hour is only 10 mg. Fentanyl
Mallinkroft 100 mcg/hour is only 11 mg. Fentanyl
Duragesic brand 75mcg/hour is 12.8 mg. Fentanyl meaning HIGHER then both generics.

Chemically there are two Fentanyl types used; one is superior and it is the one used in brand.

The FDA mandate affects all prescribers no more than 120 mg. morphine equivalent they can go over for example as for a rare case like me--no one is going to do this the first year or so until the FDA sees enough dead people to up the suggested high end.

You also will get legal actions if you obtain class 2's from multiple prescribers. You could be arrested. Pharmacists under Odumma have authority over a prescribing physician to make a call which can be local LE, the DEA, or whoever and also to override a physician by stating to the patient "I'm replacing your Percocet with Lortab."

Just in case Joey is busy I sent him a long and involved email as I am hoping he can get me a referral I decided to give you my two cents worth. There is no humanity now either Kipper; the physicians do not want trouble and in my case seeing the top in America resulted with new regulations release of 30 out of state patients. It is not abnormal for rare medical cases to have to refer to out of state physicians, but in this case I can soon be pushing up daisies.

Hope that helps if your insurance limits you to quantity on the patches have the doctor write brand necessary so you get more of the opioid content, better quality and have them do a P450 analysis it is done by buccal swab.

Kipper you sound so familiar sigh..

Kipper, Let me help you with insurer cost. (5) name brand Duragesic 100 mcg/hour is costing the insurer over $1,000 my normal medication bill was $ 25,000 give or take a few MONTHLY. These patches are left on not removed to avoid over medication. Perhaps you should discuss with the physician why they dropped you a point I will state before I send this message.

I knew another patient I referred same deal. She would go to the post op anesthesiologist who worked with her surgeon and obtain Dilaudid from him her regular PM did not write it. Both knew, and when the anesthesioglist
decided too much heat, too many patients he used the same reason--seeing two physicians and she washed. Permanently in today's heavy cut back world of pain management and out where you reside it will not be easy to replace these physicians. Further your surgery is recent they will expect LESS pain in the next six months or so.

Good luck. Read my other posts for my credentials.

I'll do the best I can, Thanks for recognizing that this is out of my league — in terms of specialties – but I'm good at roundin' up folks when there's a need. My Mom — God rest her soul — was the same way!

Eddy you are absolutely correct.

Stace you can find a physician to prescribe your medications if you are consistently on them with proper diagnoses.

I wish you the best.

There are the rules and then there's god medicine. Calling the AMA is like asking Nixon if it's cool to break into a office to steal the secrets you need! You should have checked with the Idaho Medical Association and found out what their "Enforcement Arm" is. The NY, it's the Office of Professional Conduct of The State Board of Medicine. That means they can suspend or revoke licenses, etc. My knowledge of orthopedics and rheumatology are a bit limited, but I read enough to know that you need for opiates in legit, bro. I have a colleague on Remicaid and I called to wish her Happy Holidays (Roni's Jewish and a teacher; her husband's a shrink at Bellevue. We both love to read; I have an BA/MA in English and we asked him to het us adjoining rooms when we finally go nuts from our jobs. She takes Remiacid and I said that dose sounded pretty lotto me. She's a smart girl, a doctor's wife, a REAL MA holder (no master's in English Ed ir other b.s.) and knows what she's taking) Some of us, I truly believe, are put this Earth with special talents or greater intelligence, but "to whom much much is given, much is expected. I lucked out. Mom had a PhD with High Honors and more awards than we ever could find places for — thank God she had a big office as Supt of Schools. My Dad was a successful businessman. There's money in the family. I was smart enough to fly through school and get accepted to my only three choice of med school. (Most kids applied to 20). I found I had a talent for listening, a crack memory and was able to put all the pieces together and come up with a plan that works" — thats called synthesis. I learned that when I got my PhD in pharmacology.

Now, your meds schedule was a little peculiar, but no beyond what I'd consider the normal limit of opiate therapy for your condition. I had SEVERE migraine-type headaches for seven years. My mentor, my best professional bud (and my shrink) and I all with advanced training is psychopharmacology, tried to figure out what to do that would work. We did and redid every neural scan available. I had blood diagnostics I can't even pronounce. Nothing worked by Percocet 10/325 - 2 or 3 q4-6h prn pain and brand name Valium; sometimes Thorazine 25mg for nausea. (Decxtrostat - dextraoamphetmine) 10mg PRN kept me on my feel to do my work). I know what it's like to wake up with pain and go to sleep with it. I used Dilaudid 2-4mg fro breakthrough and usually generic Seconal (gr iii) for sleep. Definitely file a complaint. Your doc ANNOT drop you without providing enough medication for one month and providing you with referrals. I don't care what pseudo-health professional tells you what, bro; I'd bet the rent money that this is written into Admin Law or the laws of your state. This really sucks. I'd NEVER know anyone, even "shady" docs do this, but I don't know any REALLY shady (make up histories, sell scripts, etc.) docs. I wouldn't want to; they tar our whole professional with the same brush. FIRST STOP: Law Clinic, probably at a major university with a law school, to get your options. (I mean no disrespect), but I've treated guys like you — usually at no charge — because the consequences of being out of work don't lend themselves to paying my $385/session fees (that figure is for my affluent patients actually, and I was left a bunch of them by my mentor, who finally retired about 52 years of practice). See what they have to say. I"m SURE there are violations here and that;s everagem my friend My baby sister represented a patient if mine against another doc and, bearing in mind that she's a former Chief Sex Crimes Prosecutor and is young, pretty and harmless-looking, ripped this drug-pushing a---e to shred and his licensed was revoked, he was fined $10K and he was locked up by the Fibbies on the way out the door. She didn't charge this girl either Same sit, basically as yours. Good luck and good speed!

I was in a bizarre accident in September, broke every bones in my cheeks, dislocated my hip and deliberately forgot the rest. I was at a hospital NOT my own and their shrink tried to play "Can you top this" I had OUR Chiefo f Staff call their Chief of Staff they went med school together — and he said he was sending over a lock of doctor and he waste give them and me full privileges. My sister, a great attorney, used her kid DA;s budget get to the old bastard in charge directly and said she would be back in two hours with a Court order signed by a US Appellate Court Judge who also is a Federal Court 'judge fir the Third District ORDERING HIM TO COMPEL WITH THE REQUEST IN MY SISTER'S MOTION IMMEDIATELY, SINCE ALL ARE ULLY-LICENSED SPECIALTY TRAINED AND WELL REGARDED PHYSICIANS. As for the shrink, I told him not to try to show me he;s smarter than I am. He;s not. I went to better schools and got better grades (Ethel's being a nice guy. A few calls to MY primary hospital we have two huge hospitals, but call the one I have my official office "primary" and gave my other big officiate my Assistant On Site. Without my permission, they added Ketalar to my anesthetic cocktail and I woke up screaming. The "recovery room" looked like a Sheltered Workshop for the Developmentally Disabled and people were engaged in activities and things appropriate to that. The "nurse" in charge wore a cardboard sign around her neck and didn't believe I was an MD., When I asked her three simple questions every RN should know and she could;t answer them, I did. I told her my license # and my NPI #. No dice. I was placed in restraints and, my mind intact, I realized this COULD NOT BE A RECOVERY ROOM. I've been in too many as a pt and a doc. I also know puts died from anesthesia shock and other complications and thought I might have passed...but if so, this was NOT anything near Heaven. Figuring the most potent powerful for for good — that of Our Lord — is the most potent weapon against against Absolute Evil (and this had to be the work of Satan, I reasoned), I started praying, aloud in perfect Latin. (Good memory.) Meanwhile, my sister was calling her friends at th DA;s office and the local precinct to prepare warrants alleging unlawful imprisonment. This NURSE (whom the hospital never seemed to be able to find — I found her — believe it or not the firm rec'd to me was run by former Fibbie who also was a former patient; "For you doc, on the house, You gave me my life back. He wasn't a scheduled patient but had OD'd on gluthetemide — DORIDEN — and my mentor taught me to treat this nasty OD.) The nurse in charge kept telling my sister "I wasn't ready. I was still hallucinating; I was confused." Naturally, I was confused. It's like gin to the Apple Store and finding yourself surrounded my Harry Winston diamonds! I'm not a crazy fundi Christian or crazy fundie Catholic. I don't think every this patient is possessed by a demon. I believe that, on this Earth, God's work should surely be our own and THIS was not Gods work by a longshot! They didn't release my. There were two Fibbies serving the Search Warrant, two NYPS detectives and two DAs investigators, along with a DA Bureau Chief who dated my sister. My own shrink and another did;t know signed off that under the circumstances, my background, training and religious background made my thinking I was in a Satandesigned Hell was quite logical. My shrink was vehement about MY NOT being DELUSIONAL or otherwise nuts. The copes had a huddle. MY sis emerged, nodded to the DA Bureau Chief who was thereto authorize anapest and she said, "Llock her u Kidnapping; Unlawful Imprisonment, Gross Negligence in the Practice of the Profession and anything else we can think up while processing her. This is the big time, sweetie. NO WARNINGS FOR YOU. YOU DOING TIME. Hospital Security physically tried to stop the LEOs from doing their jobs, the FBIM Sspecial Agent in Charge said, "Cuff 'em. You're under arrest for obstructing a federal investigation" I pointed o the two attendants who grabbed my teeshirt and played "keep away" — and these two for carrying out illegal directives (the DA Bureau Chief added another charge or two). And off to the Federal Building, the local precinct, etc. A doctor tried to intervene. The FBI SAC had enough. "You're under arrest for obstruction of the administration of a federal investigation. Hands beinhd your back and we;ll look special for a FELONY so you won't be burdened with this job any longer." I told the group he was an a**hole who added Ketalar (beta, one; Special K) to my anesthesia; The DA Bureau Chief said, "WE'll hold him pending verification of charges of Unlawful Introduction of a Controlled Substance Without the Patient's Consent; Poisoning and whatever else our Doc can come with. Meanwhile, we proceed on Dr Joey's sworn statement to be given.) Sometimes, God really is on our side.

A 19-year old who "didn't want Xanax in the first place." I'm am MD and a PhD on pharmacology. That first degree doesn't stand more "More Dumb". I've been doing this a long time. Diagnostic bs aside, you WANTED that Xanax. I've had patients who did't like the way Xanax or Klonopin or librium made them feel and they threw out the bottle. You stayed on it for HOW MANY YEARS! Cry me a river, why dontcha? Were the docs that scare you because you CAN'T b.s. those with our background and experience. WE almost NEVER rotifer Xanax for 18 or 19 years olds in didn't 15 years ago either. Too addicting because of it;s short acting properties. Good sob story. I haven't read your "DDxs" in detail yet, but wouldn't be surprised if they're fishy to nonexistent.

You also need a thorough psychiatric workup performed by a couple of competent Board-certified shrinks who have been around the block too long to be scammed, Whacked how you started? You became adducted to Xanax Period. End of story.

Morning Joey there is one such statement that any patient evaluated by a psychiatrist is asked especially if they are visiting due to extreme anxiety.
1. Typically a person in therapy complains of chest pain, sweats and racing heartbeat.
2. If not under medication management a reputable therapist will refer to a psychiatrist and therefore, the patient is asked questions FIRST.

Do you have any addiction history? ETOH? (alcohol abuse)
Street drugs?

Joey is absolutely on the mark--if you answer yes to any of these and are having panic attacks which may or may not be evident from assessment you will not be prescribed Xanax.

I had stated the same thing myself for Stace's post jumps--I saw it on another area of forum and it said 2012 then got blasted by several that it was recent.

Perhaps there are two of the same name do not know but I concur with Dr. J's assessment.
