How come my Dr keeps telling me that with oxymorphone 40mg you do not get breakthrough meds and refuses to give me anything else.Been on same dose over. 3years and meds do not work like they used to.Is it just me who deals with extremely strict guidelines. I know others are getting BT meds and he thinks I'm dumb.Is 3years too soon to expect med increase?

No, you are not the only one dealing with this, there have been many people complaining about it all over the U.S.
The amount of time it takes for someone to become tolerant to a medication and need an increase can vary from person to person, so there is no time frame for that.
What type of doctor are you seeing? Is he a pain specialist or a PCP?
