Broken Locking Screws

I had severe fall from several feet to cement-multiple compound fractures-minimal insurance-regardless pain increased after approx. 3months.(M.D. was CERTAIN of bone infection-I believed him incorrect as I have medical background) I had MRI which stated no osteomyelitis and after reading report didn't return. Didn't have blood work(was just to check for infection) so redundant. Eventually returned as pain and pain meds were awful and he starts nearly screaming the fractures were back-screws broken and blamed me for not following up! Was I supposed to go to money tree and have MRI weekly? No way to know why this happened-but what would cause screw heads to break off? Wasn't exactly jumping up and down. (tri-malleolar tib-fib) Now using bone stimulator and switched Docs. Never saw guy who did surgery-(was out of state) I have gut feeling the hardware is causing pain-but may not be able to remove. Don't know what to do. Can I sue hardware co. for broken screws? Anonymous
