Pending Drug Charge No Rx Refill

My doctor will not refill my oxymoron or my fentanyl patches because of a pending drug charge. I have been on them for years. How can they just stop them? If I go to another doctor will it be in my medical records? I thought you were innocent until proven guilty.

Hello, Justice! How are you? I'm very sorry about the problem you're having.

Your doctor can stop prescribing anything, at any time, for any reason. Unless you are in immediate life-threatening danger, they are under no obligation to treat you, prescribe anything, or keep you on as a patient, just the same as you are not obligated to keep seeing any particular doctor or take any prescribed medication, except for rare cases of being under court order.

Yes, it will be noted in your medical records for all medical professionals. Innocent until proven guilty is a legal precedent, not a medical one. If your doctor feels they have reason to worry that you were doing something illegal involving drugs, prescription medications or others, then they can validly stop prescribing.

The FDA classifies this medication as a narcotic analgesic, so it has the potential to be habit forming and may cause side effects, such as nausea, dizziness, drowsiness, dry mouth and constipation.

I'm not trying to justify it, either way, I'm just explaining the way it works under current law. I'm sorry, I know it's not very helpful, but there's really not much that can be done about it. You are not the first and I am certain you will not be the last person to find themselves in such an awful situation. Some people didn't even have any pending charges or anything, they just had a vindictive spouse or ex that called their doctors telling tales.

If you find yourself undergoing dangerous withdrawal symptoms, you can seek emergency medical attention, where they would have to treat you, until such a point where you become stable and are out of any possible life-threatening danger. Even then, however, they are not obligated to prescribe anything, they only have to treat you there, if you are in danger.

Does anyone have any ideas for a possible solution or some advice to offer?
