Legality Of Operating A Business While Wearing Fentanyl Patches

Is it legal to operate a business or make business decisions when under the influence of Fentanyl patches?

Yes, there is nothing illegal about it. You can operate your business, legally, under the influence of anything, including illegal drugs or alcohol, but if you make bad decisions, you are the one that will have to face the consequences. If you are caught using illegally, you may face criminal prosecution for using illegal drugs, or if you scammed people or cheated them, but you will not actually be prosecuted for having operated a business, while using a medication.

The only way it would be illegal is if someone was operating/running something, where being under the influence of such could put the lives of others in danger. This is why air traffic controllers cannot work, while they are under the influence of controlled substances, the same applies to pilots.

If you have a prescription from a doctor licensed to prescribe Fentanyl you cannot be kept from running a business or working your regular job. You must follow your doctor’s directions regarding the use of the medication such as how often to change the patch. HIPPA laws protect people from discrimination due to illness.
