Is It Legal To Write 6 Postdated Scripts For Ritalin At Once?

Updated

I live in Kansas. I have taken Ritalin for about a decade for ADD. I am a 53 year old male. My favorite shrink (sorry, I cannot spell the correct term) retired about 5 years ago. It took me a few years to find a shrink I liked. For the last 3 years I have been using the same shrink. I am also DX'd with ADD and small fiber neuropathy (SFN). I live in a small town (Less than 30K). I had to reach out 2.5 hours to find a shrink that would prescribe Ritalin. We have a good relationship. I saw him two weeks ago. For the last year (maybe more) he has written me 6 post-dated scripts in a row. This due to the long drive and to help keep my office visit costs down. I am disabled and have a fixed income. Additionally, SFN is quite fatiguing. So the drive itself is challenging for me. I am also BP2. I take 300mg of Seroquel before I go to bed. I also take 150mg of Bupropion XL for depression. I also take 3,000 mg of Gabapentin a day for my SFN.

The last time I saw him (8/7/17), I filled the first script of Ritalin before I returned to my small town. I did this because recently I changed Health Insurance Plan D. I use Express Scripts now. I know they are part of Walgreens and since this RX was for 105 count for the month rather than the usual 100 count, I knew I could fill it because it was a 'new' script with a different dosage. While Walgreens was filling my Ritalin RX, I was cleaning out my messy car. In the process, I seemed to have lost the other 5 scripts of Ritalin. He post-dates and writes me six different RX's for the same med (Ritalin). It used to be six individual, disconnect sheets of paper. Now his PC prints out the scripts on one sheet of perforated paper -- then he signs and dates them. The first week, I did not even notice that the RX's were missing. I was organizing and recovering physically from the drive. The next week I got to thinking, "Hey, I don't remember seeing my RXs for Ritalin. This is not cool."

So for the next week I search EVERYWHERE. I could not find them. My guess is that they got lost in that Walgreens parking lot when I was waiting for the RX to be filled (and cleaning out my car while waiting). I called the Dr's office on 8/21/17. I asked to speak to the office manager. I explained my problem. She did not seem very happy with me. I told her that I have NEVER lost a script in my LIFE (which is the truth). She told me the doctor would have to call me back later. Today makes Day 5 since I last called their office. He has not called me back. I don't think he will call me back. I needed him to send in some papers for FMLA once, that only got done (just in time) after several calls to his office.

Here are my questions:

In the state of KS, is it legal for him to post-date six scripts in a row for Ritalin? Some say 'yes', some say 'no'. Therefore, I am confused. Soon I will be without medicine (Ritalin). I have a few old scripts of his for Klonopin. I never turned them in, because my GP upped the dose. I have three of these scripts. They are dated as follows: Aug 24, 2026 -- March 8, 2016 and Feb. 21 2017. They could be sent to him as 'proof' that i do not sell my RX's. Or, he may view it as, "he simply hasn't found a customer for them yet."

I can print two years off of my former insurance's site showing that I have ALWAYS used my scripts and have never lost one. Some are saying he is not getting back with me because he knows that writing and post-dating 6 scripts for Ritalin is against the law. He hopes I will fade away so he will not get caught. I view it like this: it was my mistake. Fine. I will drive in again and talk to him about this ONE TIME problem (it was rush hour in a large city, so I was rushing, trying to beat the traffic. Mistake.) and some ideas how to make sure it never happens again. In any event if he no longer wants to be my shrink because of this ONE mistake, then he at least has an ethical duty to help me find a new doctor or to continue to be my doctor but lets change the way I get my RX's. Mail them to my GP for example. Anyway, soon I will be without Ritalin. It is an exhausting 5 hour round trip for me to see him.

What would you do if you were in my situation? And back to my first question:

In the state of KS, is it legal for him to post-date six scripts in a row for Ritalin? Thank you.
