I live in Pennsylvania. I receive a 28 day prescription of subutec at 16mg a day. My Dr miscalculated and is on vacation and won't return until 32 after my last appointment. Which leaves me 4 days without my medication. He told me that it is against the law to call anything in for me and that I have to try and stretch what I have to make it until he can see me. Is that true or is it legal and possible for him to call in the 4 day prescription until I can see him? Especially based on the mistake being on his part and not on mine. Could I go to an Er and receive the subutec if it is against the law to call it in? I dont know what to do and I am frustrated with the situation.

The doctor is correct, it is now against the law for him to call it in for you. It must be a new prescription each month that you carry to your pharmacy, and is signed by your doctor. I know, it is frustrating, but if he tries to do otherwise, he could lose his license to practice medicine, as well as face fines and jail time. Some doctors do post-dated prescriptions, which they could also get in trouble for writing. (This is in reference to controlled substances.)

And no, most ERs will not prescribe it for you. If you are in imminent danger of death, they are required to treat you and stabilize you, but that is it. They do not have to prescribe you any given medication, nor do they have an obligation to treat you, once they have you stable and out of danger.

I am sorry, I know this is not very helpful, it is ridiculous, and I am not expecting you to be happy with this news, I am just telling you how things currently stand under U.S. FDA law.

I went to the ER once and was totally miserable. I thought I had a urinary tract infection, but it turned out I had a kidney stone. (Before I complete this tale, please note that I do not drive and did not have my own transportation.) A sweet neighbor took me to the ER and stayed with me, then made sure I arrived home safely. They gave me a pain medication while I was there, since I wasn't driving, as well as a prescription to take for a few days, until the stone passed, or I could see my PCP for further treatment.....I finally got a few hours sleep, then took the prescription to a local pharmacy, only to discover that the doctor had forgotten to write in his DEA number, so the pharmacist had to tell me that she could not legally fill it.

I ended up having to take a bus, in tremendous pain and crying the whole way, back to the ER, since I did not want to bother that neighbor again, (RIP Dotty), had to explain the issue to an admitting nurse, who thankfully was able to fix the problem, then take the bus back to the pharmacy closer to where I lived to have it filled.

Abusers and addicts have caused chaos for so many people.
