False Positive Oxycodone

My grandson was taken from his parents due to methamphetamine, they did a hair follicle on him and he came back positive for methamphetamine and oxycodone. The lady at social services made it to where I can only be with him supervised because I have a prescription, but I take my meds as directed and I don't know how he tested positive. Could my tears have caused it because I cry all the time? The social worker called me a druggie and keeps my grandson from me. I don't know what to do or how this happened but he was only a month old. I was never alone with him. I never did anything. Please help me :(

A hair folicle test goes back 90 days. It is likely his mother had been using while pregnant and that is how it ended up in his system. I am assuming the same for the meth. Do you ever have pill counts at your doctor's office? If so you could have those records pulled to prove you take your meds as directed. If not you may want to ask them to start having you come in for random pill counts. My suggestion would be to file for custody (or visitation) in family court. The courts like to keep families together. Sometimes child protective services have other hidden agendas. I know in the county I live they used to give foster care children to people who work at DSS. So, as I said, I would file in family court for custody. When you do that you can also file for a court appointed attorney if you can not afford one. Get a letter from your doctor as to their opinion of whether or not your prescription drugs would limit your ability to care for an infant. There are things you can do and you do have certain rights as a grandparent. I hope this helps and wish you the best for both you and your grandchild.
